Avril nicking lyrics?

If you thought Avril Lavigne’s single Girlfriend sounded a bit familiar, you weren’t the only one – songwriters James Gangwer and Tommy Dunbar are so convinced she ripped them off that they’re suing the tiny Canadian singer.
Gangwer and Dunbar wrote I Wanna Be Your Boyfriend for The Rubinoos way back in 1979, and claim that Avril’s bouncy Girlfriend is almost identical. Well, it’s true that both have a bit that goes “Hey, hey, you, you, I wanna be your boy/girlfriend” but can you really copyright that? Some lawyers obviously think so.
Avril’s made a baffled statement claiming never to have heard of the long-defunct Rubinoos. “They have a song called I Want To Be Your Boyfriend that has no musical similarities to the song Girlfriend that Luke Gottwald and I wrote together," she huffed on her Myspace page.
She went on to say: "They claim that a small part of the lyrics are the same and are saying that I took these from them. I had never heard this song in my life and their claim is based on 5 words! All songs share similar lyrics and emotions. As humans we speak one language. Off the top of my head, two other songs that I can immediately think of with this type of lyric are "Hey, hey, you, you get off of my cloud" by the Rolling Stones and "Hey little girl I want to be your boyfriend" by the Ramones. Simply put, I have been falsely accused of ripping their song off. Luke and I have done nothing wrong and there is no merit to their claim."
We don't know, but we do reckon the people who wrote the bubblegum 80s hit Hey Mickey should look into those handclaps...
